Resolution No AG-2004-RES-16

Co-operation Agreement with the International Criminal Court


The ICPO-Interpol General Assembly, meeting in Cancún from 5 to 8 October 2004 at its 73rd session:

BEARING IN MIND Articles 2(b) and 41 of Interpol's Constitution,

HAVING EXAMINED Report AG-2004-RAP-13, which sets out a draft Co-operation Agreement with the International Criminal Court (ICC),

CONSIDERING that the crimes which come within the jurisdiction of the International Criminal Court also fall within the aims of the Organization as defined in Articles 2 and 3 of the Constitution,

ALSO BEARING IN MIND in this connection Report AGN/63/RAP/13, submitted at its 63rd session (Rome, 1994), on co-operation with the international judicial bodies competent to judge crimes coming within the jurisdiction of the International Criminal Court, particularly in light of Article 3 of Interpol's Constitution,

RECALLING its previous Resolutions, AGN/63/RES/9 (1994), AGN/66/RES/10 (1997) and AG-2003-RAP-08 (2003), by means of which the Organization undertook to co-operate with the international institutions responsible for prosecuting the perpetrators of serious violations of international human rights,

DEEMING that the draft agreement at Appendix 2 of Report AG-2004-RAP-13 is in conformity with the Organization's interests and rules,

RECALLING that it is the responsibility of each member country to determine whether and to what extent it wishes to contribute to co-operation with the International Criminal Court,

APPROVES the Co-operation Agreement at Appendix 2 of Report AG-2004-RAP-13;

AUTHORIZES the Secretary General to sign the said Co-operation Agreement.
