Resolution No AG-2002-RES-09 

Draft rules relating to the processing of police information, to the control of the processing of personal information, and to the access to that information (Rules relating to the processing of police information)

The ICPO-Interpol General Assembly, meeting in Yaoundé from 21 to 24 October 2002 at its 71st session:

MINDFUL OF Report AG-2002-RAP-06 which presented a preliminary draft set of rules relating to the processing of police information,

CONSCIOUS of the need to amend the existing rules with a view not only to simplifying and harmonizing them but also to equipping the Organization with the legal instruments that are necessary for its development,

NOTING the conclusions of the special meeting held on 21 October 2002 in Yaoundé,

DEEMING it essential to discuss and finalize the draft rules in the appendix of Report AG-2002-RAP-06 as quickly as possible,

DECIDES to set up a Working Group for this purpose and ADOPTS the terms of reference as set out in the appendix to the present resolution;

ASKS the Secretary General to take the necessary measures to ensure the smooth running of the Working Group;

URGES Member States to become involved in the study and to participate actively in the tasks of the Working Group;

ASKS the Working Group to report to the General Assembly at its 72nd ordinary session, to be held in 2003;

AUTHORIZES the General Secretariat in the meantime to continue to create databases that are set up in accordance with the governing principles deriving from Interpol's Constitution, in co-operation with participating NCBs and subject to the supervision of the Executive Committee.

ORIGIN OF THE TERMS OF REFERENCE

Resolution AG-2002-RAP-09 of the General Assembly (71st session, held in Yaoundé, Cameroon, 2002)

 

TERMS OF REFERENCE

The Working Group is tasked with finalizing the draft rules relating to the processing of police information, taking into account the principles decided upon at the special meeting of Member States held on 21 October 2002 in Yaoundé.

The draft rules finalized by the Working Group will be submitted to the General Assembly at its ordinary session in 2003.

 

COMPOSITION

The Working Group shall be made up of officials from the General Secretariat and a minimum of five (5) representatives from the National Central Bureaus. If at all possible, the Working Group should include representatives from all four regions of the Organization.

Member States will participate in the activities of the Working Group at their own expense.(1)

The Working Group's secretariat will be provided by the Secretary General who will appoint one or more of the Organization's officials for this purpose.

The Working Group shall determine its own Rules of Procedure, according to its needs and in whatever form it chooses.

The Working Group shall appoint, from among its members, a President and a Vice-President tasked with co-ordinating work and reporting to the General Assembly at its ordinary session in 2003.

Interim reports on the progress of the Working Group's activities will be submitted to the Executive Committee for information at all its sessions.

 

DATES AND LOCATIONS OF MEETINGS

The Working Group will decide the dates and locations for its meetings.

If a Member State proposes that one or more of the Working Group's meetings be held on its territory, it will be responsible for organizing the meeting(s) in co-operation with the Working Group Secretariat and ensuring that all members of the Working Group are able to take part in the meeting without let or hindrance.
