Australia has a federal system of Government comprising the
Commonwealth, six states and two territories. The Commonwealth’s legislative
powers are limited to those powers set out in the Commonwealth Constitution.
The legislative powers of the States are unrestricted. In the event of inconsistency
between Commonwealth and State laws, the Commonwealth law prevails to the extent
of the inconsistency. Child pornography law is predominantly a State matter.
However, regulation of broadcasting services, including television and radio,
is a commonwealth matter.
